Effective [DATE]. This policy applies to all Liberation Technology Services reseller hosting accounts and to the end-client accounts created under them. Where this policy conflicts with our Terms of Service, this policy controls for reseller accounts.
1. When We Take Action
Liberation Technology Services (“Liberation”) will suspend, restrict, or remove a reseller account, or any end-client site hosted under a reseller account, only for one of the following reasons:
- Unlawful use. The account or site is being used in violation of applicable U.S. federal, state, or local law.
- Non-payment. Payment for the reseller account is past due.
Liberation may also take temporary, narrowly limited action to stop an active security threat or resource abuse, as described in Section 2. That action is limited to what is needed to fix the technical problem.
Liberation does not suspend or remove sites because of lawful content, viewpoints, political or religious beliefs, or because a third party finds lawful content objectionable.
2. Reseller-First Notice
If an issue arises with an end-client site, Liberation will contact the reseller, not the end client, using the contact information on the reseller account.
Liberation will give the reseller at least fifteen (15) days’ written notice before taking action, along with a description of the issue and a chance to fix it.
The only exceptions are when Liberation must act sooner because of:
- applicable law, a court order, or a law-enforcement request;
- an active security threat, such as malware, a compromised account, or an attack originating from a hosted site; or
- resource abuse that degrades service for other customers on the same server.
In those cases, Liberation will take only the narrowest action needed to address the problem, such as isolating a single site rather than suspending the reseller account. Liberation will notify the reseller as soon as it is legally permitted to.
3. Renewal Pricing
Reseller plans renew at the price in effect when the reseller signed up. If Liberation needs to change a plan’s price, it will notify the reseller before the renewal date, and any increase at renewal will not exceed five percent (5%) of the prior term’s price.
4. End-Client Relationships
End clients belong to the reseller. Liberation will not market to, solicit, or bill a reseller’s end clients.
If an end client contacts Liberation directly to ask for services, Liberation will notify the reseller and give the reseller first right to provide the requested work or service.
5. Ownership
Liberation Technology Services is independent and American-owned. Reseller accounts are hosted on servers Liberation owns and operates in the United States.
